Is your lender foreclosing on your home?  Filing bankruptcy will stop your foreclosure!!!!!  Either filing a Chapter 7 bankruptcy or a Chapter 13 bankruptcy will stop your foreclosure under the automatic stay provision of the U.S. Bankruptcy code.  However, if you want to keep your home then you will either have to catch up on all your provisions or modify your home loan.  In certain situations we may be able to negotiate with your lender and have your past due payments wiped away or in some situations we may even be able to reduce the principal amount of your loan to today's fair market value.  Filing a Chapter 13 bankruptcy will not necessarily eliminate your past due amount however, it will allow you to pay the past due amount over a three to five year period.
